Qualitative evidence concerning the relationship between QoL and a wide range of disabilities suggests that subjective judgments regarding other people’s QoL are wrong more often than not and that such judgments by medical practitioners in particular can be biased. Guided by their desire to do good and avoid harm, surgeons often rely on "the eyeball test" to decide whether a patient will or will not benefit from surgery. But the eyeball test can easily harbor a range of implicit judgments and (...) biases against patients with disabilities, including erroneous assumptions about QoL. We critique the use of the "eyeball" test and offer suggestions to reduce bias and ensure that patients’ values are more consistently prioritized in surgical decision-making. (shrink)

In order to improve our understanding of the components that reflect functionally important processes during reward anticipation and consumption, we used principle components analyses (PCA) to separate and quantify averaged ERP data obtained from each stage of a modified monetary incentive delay (MID) task. Although a small number of recent ERP studies have reported that reward and loss cues potentiate ERPs during anticipation, action preparation, and consummatory stages of reward processing, these findings are inconsistent due to temporal and spatial overlap (...) between the relevant electrophysiological components. Our results show three components following cue presentation are sensitive to incentive cues (N1, P3a, P3b). In contrast to previous research, reward‐related enhancement occurred only in the P3b, with earlier components more sensitive to break‐even and loss cues. During feedback anticipation, we observed a lateralized centroparietal negativity that was sensitive to response hand but not cue type. We also show that use of PCA on ERPs reflecting reward consumption successfully separates the reward positivity from the independently modulated feedback‐P3. Last, we observe for the first time a new reward consumption component: a late negativity distributed over the left frontal pole. This component appears to be sensitive to response hand, especially in the context of monetary gain. These results illustrate that the time course and sensitivities of electrophysiological activity that follows incentive cues do not follow a simple heuristic in which reward incentive cues produce enhanced activity at all stages and substages. Despite a large and multifaceted effort to understand the vast landscape of phenotypic data, their current form inhibits productive data analysis. The lack of a community-wide, consensus-based, human- and machine-interpretable language for describing phenotypes and their genomic and environmental contexts is perhaps the most pressing scientific bottleneck to integration across many key fields in biology, including genomics, systems biology, development, medicine, evolution, ecology, and systematics. Here we survey the current phenomics landscape, including data resources and handling, and the progress that (...) has been made to accurately capture relevant data descriptions for phenotypes. We present an example of the kind of integration across domains that computable phenotypes would enable, and we call upon the broader biology community, publishers, and relevant funding agencies to support efforts to surmount today's data barriers and facilitate analytical reproducibility. Some researchers and autistic activists have recently suggested that because some ‘autism-related’ behavioural atypicalities have a function or purpose they may be desirable rather than undesirable. Examples of such behavioural atypicalities include hand-flapping, repeatedly ordering objects (e.g., toys) in rows, and profoundly restricted routines. A common view, as represented in the Diagnostic and Statistical Manual of Mental Disorders (DSM) IV-TR (APA, 2000), is that many of these behaviours lack adaptive function or purpose, interfere with learning, and constitute the non-social behavioural (...) dysfunctions of those disorders making up the Autism Spectrum. As the DSM IV-TR continues to be the reference source of choice for professionals working with individuals with psychiatric difficulties, its characterization of the Autism Spectrum holds significant sway. We will suggest Extended Mind and Enactive Cognition Theories, which theorize that mind (or cognition) is embodied and environmentally embedded, as coherent conceptual and theoretical spaces within which to investigate the possibility that certain repetitive behaviours exhibited by autistics possess functions or purposes that make them desirable. As lenses through which to re-examine ‘autism-related’ behavioral atypicalities, these theories not only open up explanatory possibilities underdeveloped in the research literature, but also cohere with how some autistics describe their own experience. Our position navigates a middle way between the view of autism as understood in terms of impairment, deficit and dysfunction and one that seeks to de-pathologize the Spectrum. In so doing we seek to contribute to a continuing dialogue between researchers, clinicians and self- or parent advocates. (shrink)

Antimicrobial resistance (AMR) is a global public health disaster driven largely by antibiotic use in human health care. Doctors considering whether to prescribe antibiotics face an ethical conflict between upholding individual patient health and advancing public health aims. Existing literature mainly examines whether patients awaiting consultations desire or expect to receive antibiotic prescriptions, but does not report views of the wider public regarding conditions under which doctors should prescribe antibiotics. It also does not explore the ethical significance of public views (...) or their sensitivity to awareness of AMR risks or the standpoint (self-interested or impartial) taken by participants. Methods: An online survey was conducted with a sample of the U.S. public (n = 158). Participants were asked to indicate what relative priority should be given to individual patients and society-at-large from various standpoints and in various contexts, including antibiotic prescription. Results: Of the participants, 50.3% thought that doctors should generally prioritize individual patients over society, whereas 32.0% prioritized society over individual patients. When asked in the context of AMR, 39.2% prioritized individuals whereas 45.5% prioritized society. Participants were significantly less willing to prioritize society over individuals when they themselves were the patient, both in general (p = .001) and in relation to AMR specifically (p = .006). Conclusions: Participants’ attitudes were more oriented to society and sensitive to collective responsibility when informed about the social costs of antibiotic use and when considered from a third-person rather than first-person perspective. That is, as participants came closer to taking the perspective of an informed and impartial “ideal observer,” their support for prioritizing society increased. Our findings suggest that, insofar as antibiotic policies and practices should be informed by attitudes that are impartial and well-informed, there is significant support for prioritizing society. This paper empirically investigates whether people’s implicit decision theory is more like causal decision theory or more like a non-causal decision theory (such as evidential decision theory). We also aim to determine whether implicit causalists, without prompting and without prior education, make a distinction that is crucial to causal decision theorists: preferring something _as a news item_ and preferring it _as an object of choice_. Finally, we investigate whether differences in people’s implicit decision theory correlate with differences in their level (...) of _future bias_: the preference for positively valenced events to be located in the future and not the past, and negatively valenced events to be located in the past and not the future. We find that people are overwhelmingly non-causalists. We also find that implicit causalists _do not_ make the distinction between news items and objects of choice, and that there is little to no correlation between people’s future bias and their implicit decision theory. The mind of man is central to the structure and functioning of the physical world. Modern physical theory indicates that the mind stands in a relationship of equals to the physical world. Both are fundamental, neither can be reduced to the other, and both require each other for their full understanding. This thesis is at odds with the view of the universe found in Newtonian mechanics as well as the generally held view among contemporary physicists of modern physical theory. Since (...) the Renaissance, man has come to understand a great deal about the physical world, and he has gained significant control over it. This increased power over the physical world has occurred hand in hand with the assumption that the structure and functioning of the physical world is essentially independent from his cognitive functioning. According to this assumption, if man’s cognitive capacity did not exist, the functioning of the physical world would not be fundamentally altered. This last statement is not in fact correct, and modern physical theory, and even fundamentals underlying Newtonian mechanics, provide evidence to attest to this. Nonetheless, contemporary physicists for the most part do not see that the relationship of human cognition to the physical world is radically altered in their own modern theory, theory that is supported by a great deal of empirical data. Instead, attempting to preserve the thesis that the structure and functioning of the physical world is independent of the mind while on a practical level relying on modern theory that contradicts this thesis, physicists have placed themselves in the position of wondering at times exactly what is the nature of the physical world at the same time they obtain experimental results concerning the physical world that can only be labeled astonishing in their precision and the scope of their implications. Modern physical theory consists of three main components: 1) the special and general theories of relativity; 2) quantum mechanics; and 3) statistical mechanics. There are very successful theories that have been developed on the basis of these three bedrock areas. An example of one is quantum electrodynamics. But these theories owe their conceptual foundation to the three components mentioned. The basic issues at the core of these three components also are expressed in these later theories. In addition, there are new unresolved issues of a fundamental nature concerning the conceptual integrity of these later theories that do not apply to quantum mechanics, relativity theory, and statistical mechanics. Quantum mechanics and relativity theory are areas I have written about for over twelve years. The nature of statistical mechanics has also been of interest to me during this time. But when I took a serious look in 1993 at Tolman’s (1938) The Principles of Statistical Mechanics, it became clear that the mind is linked to the physical world in statistical mechanics, a relationship I had found earlier in both relativity theory and quantum mechanics. It was after reading Tolman’s justification of the method of statistical mechanics in the original that I decided to write this book. When I found that the three components of modern physical theory all pointed to the same relationship between mind and the physical world, it became clear that the fundamental isolation of the mind from the physical world that has characterized our experience since the development of Newtonian mechanics is unfounded. Based on empirically supported principles of modern physical theory, I determined that the appropriate assumption for one’s experience, that the mind is linked to the physical world, could be stated with confidence. The impact of this change in assumption concerning the relationship of man to the cosmos in modern physical theory will find its way into our everyday experience. It will perhaps have no greater effect than in reducing the sense of isolation of man from the world that has characterized modern existence. (shrink)

In "Frailty Triage: Is Rationing Intensive Medical Treatment on the Grounds of Frailty Ethical?," Wilkinson (2021) argues that the use of frailty scores in ICU triage does not necessarily involve discrimination on the basis of disability. In support of this argument, he claims, “it is not the disability per se that the score is measuring – rather it is the underlying physiological and physical vulnerability." While we appreciate the attention Wilkinson explicitly pays to disability in this piece, we find the (...) distinction between disability and underlying vulnerability untenable both theoretically and practically. In this peer commentary, we begin with a brief overview of research in philosophy of disability concerning the meaning of the concept itself. We argue that this research demonstrates that many forms of disability do not involve underlying vulnerabilities, and, furthermore, that Wilkinson equivocates between "disability" understood as a medical category vs. "disability" understood as a feature of lived experience. We reject Wilkinson’s distinction on these grounds and offer further considerations to avoid disability discrimination in emergency and crisis standards of care contexts. (shrink)

Joint actions often require agents to track others’ actions while planning and executing physically incongruent actions of their own. Previous research has indicated that this can lead to visuomotor interference effects when it occurs outside of joint action. How is this avoided or overcome in joint actions? We hypothesized that when joint action partners represent their actions as interrelated components of a plan to bring about a joint action goal, each partner’s movements need not be represented in relation to distinct, (...) incongruent proximal goals. Instead they can be represented in relation to a single proximal goal – especially if the movements are, or appear to be, mechanically linked to a more distal joint action goal. To test this, we implemented a paradigm in which participants produced finger movements that were either congruent or incongruent with those of a virtual partner, and either with or without a joint action goal (the joint flipping of a switch, which turned on two light bulbs). Our findings provide partial support for the hypothesis that visuomotor interference effects can be reduced when two physically incongruent actions are represented as mechanically interdependent contributions to a joint action goal. In real-time, Twitter strongly imprints world events, popular culture, and the day-to-day; Twitter records an ever growing compendium of language use and change; and Twitter has been shown to enable certain kinds of prediction. Vitally, and absent from many standard corpora such as books and news archives, Twitter also encodes popularity and spreading through retweets. Here, we describe Storywrangler, an ongoing, day-scale curation of over 100 billion tweets containing around 1 trillion 1-grams from 2008 to 2020. For each day, we (...) break tweets into 1-, 2-, and 3-grams across 150+ languages, record usage frequencies, and generate Zipf distributions. We make the data set available through an interactive time series viewer, and as downloadable time series and daily distributions. We showcase a few examples of the many possible avenues of study we aim to enable including how social amplification can be visualized through ‘contagiograms’. (shrink)

Douglas Walton’s multitudinous contributions to the study of argumentation seldom, if ever, directly engage with argumentation in mathematics. Nonetheless, several of the innovations with which he is most closely associated lend themselves to improving our understanding of mathematical arguments. I concentrate on two such innovations: dialogue types (§1) and argumentation schemes (§2). I argue that both devices are much more applicable to mathematical reasoning than may be commonly supposed.

A long critical notice of Michael Forster's recent book, "Kant and Skepticism." We argue that Forster's characterization of Kant's response to skepticism is both textually dubious and philosophically flawed. -/- .

My goal in this paper is to argue that the principled approach to hearsay is consistent with the rule of law. I begin by contrasting an instrumental conception of the rule of law with a conception that views the rule of law in primarily normative terms. I then turn my attention to a recent criticism of the Supreme Court of Canada’s principled approach to hearsay and suggest that if Michael Oakeshott’s normative interpretation of the rule of law is adopted, (...) there is no tension between the principled approach to hearsay and the rule of law. Sometimes it’s not certain which of several mutually exclusive moral views is correct. Like almost everyone, I think that there’s some sense in which what one should do depends on which of these theories is correct, plus the way the world is non-morally. But I also think there’s an important sense in which what one should do depends upon the probabilities of each of these views being correct. Call this second claim “moral uncertaintism”. In this paper, I want to address (...) an argument against moral uncertaintism offered in the pages of this journal by Brian Weatherson, and seconded elsewhere by Brian Hedden, the crucial premises of which are: that acting on moral uncertaintist norms necessarily involves motivation by reasons or rightness as such, and that such motivation is bad. I will argue that and are false, and that at any rate, the quality of an agent’s motivation is not pertinent to the truth or falsity of moral uncertaintism in the way that Weatherson’s and Hedden’s arguments require. Critics of liberalism in the past two decades have argued that the fact that we are necessarily "situated" or "embedded" means that we can not always choose our own ends (for example, our conceptions of the good or our loyalties to others). Some suggest that we simply discover ourselves with these "connections." If correct, this would argue against (Rawlsian) hypothetical contract models and liberalism more broadly, make true impartiality impossible, and give support to traditionalist views like those of Alasdair MacIntyre, (...) Charles Taylor, and Michael Sandel. These same critics argue that liberalism's rejection or neglect of this supposed fact of our moral life has pernicious anti-social affects. I argue that the critics are wrong in both cases, defending what I call "strong voluntarism." In contrast both to recent critics of liberalism and the dominant trend in recent liberal thought, my defense of strong voluntarism allows that we can always choose to accept or reject any end we happen to have but that this does not lead to any pernicious anti-social effects. Communitarians like Alasdair MacIntyre, Charles Taylor, and Michael Sandel, defend what we may call the ‘social constitution thesis.’ This is the view that participation in society makes us what we are. This claim, however, is ambiguous. In an attempt to shed some light on it and to better understand the impact its truth would have on our beliefs regarding autonomy, I offer four possible ways it could be understood and four corresponding senses of individual independence and autonomy. T In [Rea 2006], Michael Rea presents an argument that presentism is incompatible with a libertarian view of human freedom and the unrestricted principle of bivalence. I aim to show that Rea’s argument fails. The outline of my paper is as follows. In Part I, I briefly explain the above three views and I present Rea’sargument. In Part II, I argue that one of the premises of the argument is unjustified.

Critics of liberalism have argued that liberal individualismmisdescribes persons in ignoring the degree to which they aredependent on their communities. Indeed, they argue that personsare essentially socially constituted. In this paper, however, Iprovide two arguments – the first concerning communitariandescriptive claims about persons, our society, and the communitarian ideal society, and the second regarding thecommunitarian view of individual autonomy – that the communitariantheory of Alasdair MacIntyre, Charles Taylor, and Michael Sandel,relies on individuals either being independent from theircommunities or having (...) a community-independent desire. I conduct an empirical analysis of the temporally asymmetric character of our epistemic access to the world by providing an experimental scheme whose results represent the core empirical content of the epistemic asymmetry. I augment this empirical content by formulating a gedanken experiment inspired by a proposal from David Albert. This second experiment cannot be conducted using any technology that is likely to be developed in the foreseeable future, but the expected results help us to state an important constraint on (...) our ability to know the future. Finally, I show that a third experiment concerning precognition, described by Michael Scriven and John Mackie, does not characterize any additional empirical content but does help to illustrate why it is unlikely that any precognition exists. A review of Douglas Husak, Philosophy of Criminal Law: Selected Essays (Oxford University Press, 2010).

My goal in this paper is to provide critical discussion of Michael Rea’s case for three of the controversial theses defended in his World Without Design (Oxford University Press, 2002): (1) that naturalism must be viewed as what he calls a “research program”; (2) that naturalism “cannot be adopted on the basis of evidence,” as he puts it; and (3) that naturalists cannot be justified in accepting realism about material objects.

Comment on "The ethical 'elephant' in the death penalty 'room'". Arguments in defense of the death penalty typically fall into one of two groups. Consequentialist arguments point out beneficial aspects of capital punishment, normally focusing on deterrence, while non-consequentialist arguments seek to justify execution independently of its effects, for example, by appealing to the concept of retribution. Michael Keane's target article "The ethical 'elephant' in the death penalty 'room'" should, we believe, be read as an interesting new consequentialist defense (...) of physician involvement in capital punishment. Alison Gopnik and Andrew Meltzoff have argued for a view they call the ‘theory theory’: theory change in science and children are similar. While their version of the theory theory has been criticized for depending on a number of disputed claims, we argue that there is a fundamental problem which is much more basic: the theory theory is multiply ambiguous. We show that it might be claiming that a similarity holds between theory change in children and (i) individual scientists, (...) (ii) a rational reconstruction of a Superscientist, or (iii) the scientific community. We argue that (i) is false, (ii) is non-empirical (which is problematic since the theory theory is supposed to be a bold empirical hypothesis), and (iii) is either false or doesn’t make enough sense to have a truth-value. We conclude that the theory theory is an interesting failure. Its failure points the way to a full, empirical picture of scientific development, one that marries a concern with the social dynamics of science to a psychological theory of scientific cognition. Despite its many advantages as a metaethical theory, moral expressivism faces difficulties as a semantic theory of the meaning of moral claims, an issue underscored by the notorious Frege-Geach problem. I consider a distinct metaethical view, inferentialism, which like expressivism rejects a representational account of meaning, but unlike expressivism explains meaning in terms of inferential role instead of expressive function. Drawing on Michael Williams’ recent work on inferential theories of meaning, I argue that an appropriate understanding of the pragmatic (...) role of moral discourse—the facilitation of coordinated social behavior—suggests the kind of inferences we should expect terms with this function to license. I offer a sketch of the inferential roles the moral ‘ought’ plays, and argue that if we accept that the relevant inferential roles are meaning-constitutive, we will be in a position to solve the Frege-Geach problem. Such an inferentialist solution has advantages over those forwarded by expressivists such as Blackburn and Gibbard. First, it offers a more straightforward explanation of the meaning of moral terms. It also gives simple answers to at least two semantic worries that have vexed contemporary expressivists—the “problem of permissions” and the commitment to “mentalism”, both of which I argue are problems that don’t get traction with an inferentialist approach. I conclude by considering ways in which this approach can be expanded into a more robust semantic account. (shrink)

I address Andrew Moon's recent discussion (2016, this journal) of the question whether third-factor accounts are valid responses to debunking arguments against moral realism. Moon argues that third-factor responses are valid under certain conditions but leaves open whether moral realists can use his interpretation of the third-factor response to defuse the evolutionary debunking challenge. I rebut Moon's claim and answer his question. Moon's third-factor reply is valid only if we accept externalism about epistemic defeaters. However, even if we do, (...) I argue, the conditions Moon identifies for a valid third-factor response are not met in the case of moral realism. (shrink)

In this article I discuss the advantages of a theory of political representation for a prag- matist theory of (global) democracy. I first outline Dewey’s disregard for political rep- resentation by analyzing the political, epistemological and aesthetic underpinnings of his criticism of the Enlightenment ideal of democracy and its trust in the power of the detached gaze. I then show that a theory of political representation is not only com- patible with a pragmatist Deweyan-pragmatist perspective on democratic politics but also (...) that Dewey’s concept of “publics”, if applied to contemporary circumstances of globalized politics, requires such a theory. I suggest a pragmatic theory of political rep- resentation that combines elements of Dewey’s aesthetics, particularly his own theory of vision, with Michael Saward’s conception of representative claim-making into the notion of aesthetic democratic representation. I defend the Seventh Letter, traditionally attributed to Plato, against Michael Frede's argument that it presents a political philosophy inconsistent with that found in the Laws. Frede argues that Plato had given up the idea of the philosopher-king in his Laws, but the 7th Letter seems to be still committed to the project. I argue the Laws, particularly with the introduction of the Nocturnal Council, has Philosopher-Rulers in all but name. I consider the education of the Nocturnal Council and (...) how it functions relative to the other constitutional structures of Magnesia. Frede advances several other arguments that the 7th Letter is spurious, but it at least escapes the most damning charge that it is inconsistent with the Laws philosophically. (shrink)

Critical review of Michael Dummett's The Nature and Future of Philosophy.

A mixed bag dominated by H & D's reductionist nonsense. This is a follow-up to Hofstadter´s famous (or infamous as I would now say, considering its unrelenting nonsense) Godel, Escher, Bach (1980). Like its predecessor, it is concerned largely with the foundations of artificial intelligence, but it is composed mostly of stories, essays and extracts from a wide range of people, with a few essays by DH and DD and comments to all of the contributions by one or the other (...) of them. For my views on the attempts of D and H to understand behavior see my review of Hofstadter's ‘I am a Strange Loop’ and other writings. -/- Much of it is very reductionistic in tone (i.e., " explains " everything in terms of physics/math and denies " reality " of psychology) but as Hofstadter notes, the quantum field equations of a water molecule are too complex to solve (and so is a vacuum)and nobody has a clue about how to explain the way properties emerge (e.g., water properties from H2 and 02) as you go up the scale from the vacuum to the brain, so reductionism, like holism, requires a great deal of faith and in fact is incoherent as one cannot even frame it's arguments without presupposing the coherence of higher order thought. Additional problems for reductionism are the uncertainty principle, chaos (e.g., no way to predict how a pile of sand will fall), the logically necessary incompleteness of math (and all thought) and the impossibility of matching higher order behaviors (e.g., language) with lower order phenomena (e.g., biochemistry), i.e., the combinatorial explosion or underdetermination. In sum, though there are many interesting comments, like nearly all writing on behavior, this work lacks any coherent account of the logical structure of rationality, which I try to give in my writings. -/- Those wishing a comprehensive up to date framework for human behavior from the modern two systems view may consult my book ‘The Logical Structure of Philosophy, Psychology, Mind and Language in Ludwig Wittgenstein and John Searle’ 2nd ed (2019).
